Welcome to GiftTracker (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our mobile application (“App”) and website located at https://gifttracker.net (“Site”). By accessing or using the App or Site, you agree to be bound by these Terms. If you do not agree, you may not use our services.

1. Use of Our Services

A. Eligibility

C. Anonymous Usage

The App allows anonymous usage through Firebase Anonymous Authentication. If you choose to create an account later, your anonymous data may be linked to your account.

2. User-Generated Content (UGC)

  • The App allows you to create and share lists, events, recipient details, and gift information (collectively, “User-Generated Content”).
  • Ownership: You retain ownership of your UGC. However, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and share your UGC as required to provide the services.
  • Sharing: You may share your lists or content with other users only with their consent.
  • Restrictions: You agree not to upload or share:
    • Content that is illegal, defamatory, abusive, harassing, obscene, or otherwise inappropriate.
    • Content that violates the rights of any third party, including intellectual property rights.

We reserve the right to remove any content that violates these Terms.

3. Prohibited Activities

You agree not to:

  • Use the App or Site for unlawful purposes.
  • Interfere with the operation of our services, including introducing viruses or other malicious code.
  • Attempt to reverse-engineer, decompile, or tamper with the App or Site.
  • Use automated tools (e.g., bots or scripts) to access or interact with our services without permission.
  • Violate any applicable local, state, national, or international laws.

4. Affiliate Links and Ads

Our App and Site include affiliate links (e.g., Amazon) and may display ads. By clicking on affiliate links, you may be directed to third-party sites. We may earn commissions from purchases made through these links.

GiftTracker participates in the Amazon Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by linking to Amazon.com and affiliated sites. As an Amazon Associate, we earn from qualifying purchases.

5. Intellectual Property

  • The App, Site, and all content provided (excluding UGC) are the property of GiftTracker and are protected by intellectual property laws.
  • You may not copy, modify, distribute, or reproduce any part of the App or Site without our prior written consent.

6. Privacy Policy

7. Push Notifications and Emails

  • We do not guarantee that the App or Site will be error-free, secure, or uninterrupted, and we reserve the right to modify, suspend, or discontinue the App or Site, in whole or in part, at any time, for any reason, including but not limited to business or financial considerations.
  • In the event of discontinuation, we are not responsible for any loss of data or access to services.
